金沙js6038 operates under the premise that all members of the College community will adhere diligently to the provisions of United States 著作权法. Each member of the College community must take individual responsibility for Copyright compliance. Members of the College community who willfully disregard the Copyright policy do so at their own risk and assume all liability.

Code Section 101 and following) mandates that all members of the 金沙js6038 community (including faculty, 工作人员, students and volunteers) respect the terms of the federal legislation and refrain from infringement of the proprietary rights of owners of Copyrights.

It is the responsibility of each member of the 金沙js6038 community to become familiar with the elements of U.S. 著作权法, and will make every reasonable effort to distinguish between permitted and prohibited 使用s of Copyrighted materials, as well as to reliable guidance pertaining to fair 使用 of Copyrighted materials in an educational setting.

One of the rights accorded to the owner of Copyright is the right to reproduce or to authorize others to reproduce the work in copies or phonorecords. This right is subject to certain limitations found in sections 107 through 118 of the Copyright law (title 17, U. S. 代码). The doctrine of fair 使用 has developed through a substantial number of court decisions over the years and has been codified in section 107 of the Copyright law.

Section 107 contains a list of the various purposes for which the reproduction of a particular work may be considered fair, Section 107 also sets out four factors to be considered in determining whether or not a particular 使用 is fair.

  1. 使用的目的和特点, including whether such 使用 is of commercial nature or is for nonprofit educational purposes.
  3. The amount and substantiality of the portion 使用d in relation to the Copyrighted work as a whole.
  4. The effect of the 使用 upon the potential market for, or value of, the Copyrighted work.

The distinction between what is fair 使用 and what is infringement in a particular case will not always be clear or easily defined. There is no specific number of words, lines, or notes that may safely be taken without permission. Acknowledging the source of the Copyrighted material does not substitute for obtaining permission.

著作权法 cites examples of activities that courts have regarded as fair 使用: “quotation of excerpts in a review or criticism for purposes of illustration or 评论; quotation of short passages in a schol陆军研究实验室y or technical work, for illustration or clarification of the author’s observations; 使用 in a parody of some of the content of the work parodied; summary of an address or article, 加上简短的引言, in a news report; reproduction by a library of a portion of a work to replace part of a damaged copy; reproduction by a teacher or student of a small part of a work to illustrate a lesson; reproduction of a work in legislative or judicial proceedings or reports; incidental and fortuitous reproduction, 在新闻片或广播中, 位于被报道事件现场的作品.”

It does not extend to any ideas, systems, or factual information conveyed in a work. The safest course is to get permission from the Copyright owner before using Copyrighted material.

当无法获得许可时, you should consider avoiding the 使用 of Copyrighted material unless you are confident that the doctrine of fair 使用 would apply to the situation. The Copyright办公室 can neither determine whether a particular 使用 may be considered fair nor advise on possible Copyright violations.
